UK Vaping Laws Explained: What Every Vaper Needs to Know in 2026
Vaping in the United Kingdom is legal for adults aged 18 and over and is regulated under the Tobacco and Related Products Regulations 2016 (TRPR), a piece of UK legislation that sets strict requirements for all nicotine-containing electronic cigarette products sold in this country. The regulatory framework is administered and enforced by the Medicines and Healthcare products Regulatory Agency (MHRA), Trading Standards, and the Chartered Trading Standards Institute. Key requirements include a maximum 2ml capacity for pods and tanks, a maximum nicotine concentration of 20mg per millilitre, and mandatory MHRA notification of all products before they can be placed on the UK market. Since 1st June 2025, single-use disposable vapes have been banned. Rechargeable vaping devices and prefilled pod kits remain fully legal for adults.
The Main Laws Governing Vaping in the UK
The Tobacco and Related Products Regulations 2016 (TRPR)
The Tobacco and Related Products Regulations 2016 is the primary piece of UK legislation that governs nicotine-containing electronic cigarettes and their components. It was originally derived from the European Union Tobacco Products Directive (TPD) and was carried into UK law following Brexit, where it has since been developed and updated independently.
The TRPR covers everything from product specifications and ingredient safety to packaging, labelling, advertising, and the notification process that products must go through before going on sale. It applies to manufacturers, importers, and retailers selling nicotine-containing vaping products in the UK.

Key Requirements Under the TRPR
• Pod and tank capacity:
No pod, tank, cartridge, or refill container used in a vaping device may hold more than 2ml of nicotine-containing e-liquid. This limit applies to every such product legally sold in the UK.
• Nicotine concentration:
E-liquids containing nicotine must not exceed a concentration of 20mg per millilitre. This is 2 percent nicotine by weight and represents the maximum strength permitted under UK law.
• Bottle size for e-liquid:
Nicotine-containing e-liquid bottles must not exceed 10ml capacity. This is why nic salt bottles in the UK are always 10ml and nothing larger.
• Health warnings:
Packaging must carry the statutory health warning 'This product contains nicotine which is a highly addictive substance' on at least 30 percent of the two largest surfaces of the packaging.
• Ingredient restrictions:
E-liquids must not contain certain prohibited ingredients including vitamins that create the impression of health benefit, caffeine, taurine, or colourants for inhalation.
• Child-resistant and tamper-evident packaging:
Nicotine-containing e-liquids must be in child-resistant packaging with tamper-evident seals.
• MHRA notification:
Products must be notified to the MHRA at least six months before they are placed on the UK market. Selling a non-notified product is illegal.
The MHRA and Product Notification
What Is the MHRA and What Do They Do?
The Medicines and Healthcare products Regulatory Agency (MHRA) is the UK government body responsible for regulating medicines, medical devices, and nicotine-containing products including electronic cigarettes. Their role in the vaping space is to receive product notifications, maintain a public database of notified products, and take enforcement action against non-compliant products and sellers.
Before any nicotine-containing vaping product can legally be sold in the UK, the manufacturer or importer must submit a product notification to the MHRA. This submission includes detailed information about ingredients, emissions data, the manufacturing process, and any toxicological information about the product. The MHRA publishes these notifications in a public database.
The MHRA e-cigarette notification database allows anyone to search for a product and confirm it has been properly notified before sale. This is one of the tools we use to verify every product before it goes on our site: https://cms.mhra.gov.uk/index.php/ecig-new

The UK Disposable Vape Ban
The Disposable Vape Ban: What Was Banned and When
On 1st June 2025, the UK government's ban on single-use disposable vapes came into force across England, Scotland, Wales, and Northern Ireland. This ban prohibits the manufacture, sale, and supply of non-rechargeable, single-use electronic cigarettes to consumers.
The primary reasons cited by the government for introducing the ban were the sharp rise in youth vaping, with disposable vapes identified as the product most commonly used by under-18s, and the significant environmental impact of approximately five million disposable vapes being discarded every week in the UK, the majority without proper recycling.
The ban specifically applies to single-use devices that cannot be recharged or refilled. It does not apply to rechargeable vaping devices, prefilled pod kits with replaceable pods, open-system refillable devices, or nicotine-containing e-liquids sold in compliant bottles.

What Is Still Legal After the Ban?
The following remain fully legal in the UK for adult purchasers aged 18 and over:
• Rechargeable prefilled pod kits with replaceable, pre-filled pods
• Open-system refillable pod kits and vape pens
• Nicotine salt e-liquids in compliant 10ml bottles
• Replacement pods and cartridges for rechargeable devices
• Vape hardware that does not contain nicotine-containing e-liquid
Everything sold by Prefilled Vapes Outlet falls within the legal categories above. We do not stock and have not stocked single-use disposable vapes.
Age Restriction Laws
The Legal Age for Purchasing Vaping Products in the UK
It is illegal to sell nicotine-containing vaping products to anyone under the age of 18 in the United Kingdom. This age restriction applies to both in-person retail and online sales. Online retailers are required to operate age verification measures to prevent underage purchases.
Under the Children and Young Persons Act and subsequent regulations, selling age-restricted products to minors carries significant penalties for the retailer. Trading Standards is responsible for enforcing age restriction compliance in the UK retail sector.
We operate age verification at checkout. Any order we identify as being placed by a person under 18 will be cancelled immediately and a full refund issued. We do not sell to minors under any circumstances.

Advertising Restrictions
How Vaping Products Can Be Advertised in the UK
The TRPR places strict restrictions on the advertising and promotion of nicotine-containing vaping products in the UK. These restrictions are also enforced by the Advertising Standards Authority (ASA).
• No advertising on television or radio.
Electronic cigarettes and their components cannot be advertised in broadcast media.
• No advertising in print media with general circulation.
Advertising in magazines, newspapers, and similar publications is prohibited.
• No advertising that appeals to minors.
Any promotional material that could be seen to target or appeal to under-18s is prohibited. This includes use of cartoon characters, youth-oriented imagery, or language directed at young people.
• No health claims.
Advertising must not suggest that a vaping product is safe, healthy, or without risk. It also must not make claims comparing the product favourably to medicinal nicotine replacement therapies.
• Online advertising restrictions apply.
The ASA's CAP Code applies to online advertising for vaping products. Targeted advertising to under-18s is not permitted.

Where You Can and Cannot Vape
Vaping in Public Places: What UK Law Says
UK law does not impose a blanket ban on vaping in indoor public spaces in the same way that the Health Act 2006 bans smoking. However, the legal position is more nuanced than simply saying vaping is allowed everywhere smoking is not.
• Private premises and businesses:
Individual venues, businesses, employers, and landlords have the right to set their own policies on vaping. Many workplaces, restaurants, and venues prohibit indoor vaping. Always check the policy of any venue before vaping inside.
• Public transport:
Vaping is prohibited on all public transport in the UK, including trains, buses, the London Underground, and within train and bus stations in most cases. Airlines prohibit vaping on board aircraft and e-cigarettes must travel in hand luggage due to battery regulations.
• NHS premises:
NHS trusts have the authority to set their own policies. Many NHS hospitals permit vaping in designated outdoor areas as part of their smoke-free site policies, but indoor vaping is generally not permitted.
• Schools and educational establishments:
Vaping near schools or on school premises is prohibited. The Tobacco and Related Products Regulations and associated safeguarding duties make it clear that vaping products must be kept away from environments where minors are present.
• Public streets and outdoor spaces:
There is no general UK law prohibiting vaping on public streets or in parks. However, local authority by-laws may apply in specific areas. Always check local rules.
Penalties for Breaking UK Vaping Laws
What Happens to Retailers Who Break the Rules?
Selling vaping products that do not comply with the TRPR, selling to under-18s, or selling banned single-use disposables after 1st June 2025 carries significant consequences for UK retailers.
• Fixed penalty notices and fines:
Trading Standards officers can issue fixed penalty notices and pursue prosecutions for age restriction violations and sale of non-compliant products.
• Prohibition notices:
Non-compliant products can be subject to removal from sale and formal prohibition notices from Trading Standards.
• Criminal prosecution:
Persistent or serious breaches of age restriction laws and product safety regulations can result in criminal prosecution.
• Business reputation damage:
Non-compliant retailers risk public exposure by Trading Standards and consumer protection bodies, which has serious consequences for an online business.
